Terms of Service

By registering, subscribing, purchasing, accessing, or using OpTrader (“OpTrader,” “we,” “us”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use this platform.

1. Eligibility and Acceptance

You must be legally capable of entering into a binding contract in your jurisdiction to use OpTrader. If you use OpTrader on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

OpTrader is provided solely for informational and educational purposes related to stock and options trading. You agree not to use the platform for illegal purposes or in violation of any applicable laws or regulations.

Important: OpTrader does not provide financial, investment, tax, or legal advice and is not a broker-dealer, investment advisor, or registered representative. Nothing on OpTrader constitutes a solicitation, recommendation, endorsement, or offer to buy or sell any security or financial product.

Any screens, rankings, “top picks,” model outputs, signals, sentiment scores, or examples are general information and may be based on historical data and assumptions. You are solely responsible for verifying all information and for all investment decisions and outcomes.

4. Trading Risk Disclosure

Stock and options trading involves substantial risk and may not be suitable for all investors. You may lose some or all of your investment, and in certain strategies (including options), losses can exceed your initial outlay. Past performance does not guarantee future results.

You acknowledge that market data may be delayed, incomplete, or inaccurate, and that you are responsible for understanding and managing your own risk, position sizing, and execution decisions.

5. No Guarantee of Accuracy

We strive to provide accurate and timely data; however, all content, data, and tools are provided “as is” without warranty. OpTrader does not guarantee the accuracy, completeness, timeliness, or reliability of any information presented. Use at your own risk.

6. Third-Party Data, Links, and APIs

OpTrader may rely on third-party services and data providers (including market data APIs, news feeds, analytics tools, and payment processors) that are subject to change, outages, or limitations. We are not responsible for delays, errors, or inaccuracies caused by third-party sources.

OpTrader may include links to third-party websites. We do not control or endorse third-party content and are not responsible for it.

7. Accounts, Security, and User Responsibility

You are responsible for maintaining the confidentiality and security of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or suspicious activity related to your account.

We may suspend or terminate accounts that we reasonably believe are compromised, used fraudulently, or used in violation of these Terms.

8. Paid Plans, Pricing, Subscriptions, Billing, and Cancellation

Important: OpTrader may offer paid plans including a monthly subscription that renews automatically each month until you cancel.

OpTrader may offer multiple paid options. Examples may include:

Automatic Renewal: If you subscribe, you authorize us (and our payment processor) to charge your payment method on a recurring monthly basis at the then-current rate, until you cancel.

How to Cancel: You can cancel your subscription at any time from within your account (if available), via the payment processor’s customer portal (if provided), or by contacting us at support@optrader.ca. Cancellation stops future renewals. Access typically remains available until the end of your current billing period unless otherwise stated at checkout.

Refunds: Unless required by applicable law or explicitly stated otherwise at checkout, fees are generally non-refundable, including for partial subscription periods or unused time. If a refund is issued in our sole discretion, it may result in immediate loss of access.

Chargebacks and Disputes: If you initiate a chargeback or payment dispute, we may suspend access while the dispute is investigated. We may provide relevant account and transaction details to the payment processor to respond to disputes.

Changes: We may change pricing, features, or availability from time to time. Where required by law, we will provide notice before changes take effect.

9. Digital Content, Reports, and “Top Picks” PDFs

Paid content (including downloadable PDFs, reports, rankings, and premium features) is licensed to you for your personal use only, unless we explicitly agree otherwise in writing. You may not resell, redistribute, publicly post, or share paid content (including by forwarding files, screenshots, or credentials).

10. Intellectual Property

OpTrader and its content, designs, branding, logos, text, charts, tables, scoring systems, and software are owned by OpTrader or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the service, no rights are granted to you.

11. Service Availability and Email Notices

We try to keep OpTrader available and functioning; however, the platform may be unavailable due to maintenance, outages, or third-party disruptions. After successful payment, access may be enabled automatically or within a reasonable processing window.

In some cases, a confirmation email may be sent. Delivery timing may vary due to email provider delays, spam filtering, or technical issues outside our control. You are responsible for ensuring your email address is correct and for checking spam/junk folders.

12. Suspension and Termination

We may suspend or terminate your access to OpTrader at any time if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created risk or legal exposure for OpTrader or other users. We may also discontinue the service or any feature at any time.

13. Limitation of Liability

To the fullest extent permitted by law, OpTrader and its owners, developers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the service, including but not limited to financial loss, trading losses, lost profits, data loss, or business interruption.

In jurisdictions that do not allow certain limitations of liability, some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless OpTrader, its owners, affiliates, and service providers from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use or misuse of the platform, your violation of these Terms, or your violation of any applicable law or regulation.

15. No Warranty

OpTrader is provided “as is” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

16. Privacy

OpTrader processes personal information (such as your email address and account details) for account access, billing, support, and platform operation. By using OpTrader, you consent to this processing. 17. Modifications to Terms

We may update these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

18. Governing Law and Venue

These Terms shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any legal disputes shall be resolved exclusively in the courts located in British Columbia, Canada.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
